CALL TO ORDER & ROLL CALL: Mayor Reimer called the regular meeting of the Anthon City Council to order on January 13, 2020 at 5:30 p.m. Council members present were Barbara Benson, Jerry Boggs, Corey Hamman and Lisa Petersen. Also present: Karen & Ron Newman, Jenny Umbach, Brooke Sievers, Mark Groth, Bob Farmer, Kevin Clausen, Sheriff Dave Drew, Allan & Polly Pithan, Angela, Keith & Korey Schrunk, Mike, Henry, Olivia & Lily Pithan, Amy Buck, Allyson Dirksen, Lt Charles Hertz, Craig Handke and Mike Kerns.
AGENDA: Motion by Benson, seconded by Petersen, to approve the meeting agenda. Carried 4-0.
PUBLIC COMMENTS: Sheriff Drew expressed his appreciation for Mayor Pithan’s dedication to working with the Woodbury County Deputies on the 28E agreement for police protection in Anthon. Kevin Clausen thanked Allan for his leadership and all the great work he and Polly have achieved for the community.
POLICE REPORT: Lt Hertz was present with the monthly Police report that showed the Deputies patrolled 42 hours and 53 minutes, responded to 5 calls for service and spent 4 hours and 22 minutes at the school.
CONSENT AGENDA: Motion by Boggs, seconded by Petersen, to approve the consent agenda, which includes minutes from December 9, 2019 meeting, financial reports as filed, Resolution 2020-01-461 Approving “The Record” as the official publication for the City of Anthon FY 2020, renew Class E Liquor License for E&S Enterprises LLC dba Anthon Mini Mart and building permit for Debra Wilson at 304 E Brady Street for a deck and ramp. Passed with a record vote as follows: ayes – Benson, Boggs, Petersen and Hamman; nays — none.
PAYMENT OF CLAIMS: Motion by Boggs, seconded by Benson, to approve the list of bills as presented. Carried 4-0.
LEGAL: Chad Thompson, Thompson Phipps & Thompson resigned as city attorney on December 17, 2019. Motion by Petersen, seconded by Boggs to approve the proposal to provide legal services for the city from Heidman Law Firm, P.L.L.C. and authorize the Mayor to sign said agreement. Carried 4-0.
COUNCIL VACANCY: Notice of intent to fill a vacancy by appointment was published December 26, 2019. Motion by Boggs, seconded by Benson, to appoint Allison Umbach to fill the 2 year term of office vacated by Tammy Reimer. Carried 4-0.
RESOLUTIONS: Motion by Petersen, seconded by Boggs, to adopt
Resolution #2020-10-462
entitled “A Resolution of Appreciation to Allan Pithan
for his Dedicated Service as Mayor to the Citizens of Anthon, Iowa”.
On roll call the vote was: ayes – Benson, Boggs, Hamman and Petersen; nays — none.
WATER PROJECT CDBG MANDATES: Motion by Boggs, seconded by Hamman, to adopt
Resolution #2020-01-463
entitled “Resolution Adopting Code of Conduct”.
On roll call the vote was: ayes – Boggs, Benson, Hamman and Petersen; nays – none.
Motion by Petersen, seconded by Benson, to adopt
Resolution #2020-01-464
entitled “Resolution Adopting Procurement Policy”.
On roll call the vote was: ayes – Boggs, Benson, Hamman and Petersen; nays – none.
Motion by Benson, seconded by Boggs, to adopt the Equal Opportunity Policy Statement. Carried 4-0. Motion by Boggs, seconded by Petersen, to adopt the Mayor’s Proclamation Regarding a Policy on the Prohibition of the Use of Excessive Force. Carried 4-0. Motion by Petersen, seconded by Benson, to adopt the City of Anthon – Residential Anti-Displacement and Relocation Assistance Plan. Carried 4-0. Motion by Petersen, seconded by Hamman, to adopt the Affirmative Fair Housing Policy. Carried 4-0. Motion by Petersen, seconded by Boggs, to authorize Jenifer D. Umbach as the alternate signator on project related correspondence for the city if Mayor Reimer is unavailable.
WATER PROJECT CONTRACT: Motion by Boggs, seconded by Petersen, to open the Public Hearing on Proposed Plans and Specifications, Form of Contract and Estimate of Cost for the Construction of Water System Improvements for the City of Anthon, Iowa at 5:49 pm. This being the time and place fixed for a public hearing on the matter of the adoption of plans, specifications, form of contract and estimate of cost for the construction of certain public improvements described in general as the Water Systems Improvements, Mayor Reimer called for any oral objections to the adoption of the plans, specifications, form of contract and estimate of cost. No oral objections were offered, and the Clerk reported that no written objections thereto had been filed. Motion by Petersen, seconded by Hamman, to close the Public Hearing at 5:50 pm.
Council Member Petersen introduced
Resolution #2020-01-465 entitled
“Resolution Adopting Plans, Specifications, Form of Contract
and Estimate of Cost for the Water Systems Improvements”,
and moved that the same be adopted. Council Member Hamman seconded the motion to adopt. On roll call the vote was: ayes – Boggs, Benson, Hamman and Petersen; nays – none. Whereupon, Mayor Reimer declared the Resolution duly adopted.
Brooke Sievers, ISG, filed a report of the bids received on January 9, 2020, at 10:00 am, and publicly opened pursuant to the resolution of the Council and notice duly posted for construction of certain public improvements described in general as the Water Systems Improvements, in accordance with the plans and specifications now adopted, as follows: Section 1 base bid plus alternate 1 & 2 low bid was $879,000.00 from Industrial Process Technology, Mitchell, SD. Section 2 base bid plus alternate 1 low bid was $214,137.00 from Cahoy Pump Services, Sumner, IA.

Resolution #2020-01-466 entitled
“Resolution Making Award of Construction Contract
for the Water Systems Improvements”,
and moved that the Resolution be adopted. Council Member Petersen seconded the motion to adopt. On roll call the vote was: ayes – Boggs, Benson, Hamman and Petersen; nays — none. Whereupon, Mayor Reimer declared the Resolution duly adopted. A special council meeting was set for January 27, 2020 at 5:30 pm to Approve Construction Contract & Bond for the Water Systems Improvements.
WATER PROJECT FUNDING: Council Member Petersen introduced
Resolution #2020-01-467
entitled “Resolution Fixing Date for a Meeting on the Authorization of a Loan and Disbursement Agreement
and the Issuances of not to Exceed $1,226,000 Water Revenue Capital Loan Notes of the City of Anthon, Iowa,
and Providing for Publication of Notice Thereof”,
and moved that the same be adopted. Council Member Boggs seconded the motion to adopt. On roll call the vote was: ayes – Boggs, Benson, Hamman and Petersen; nays – none. Whereupon, Mayor Reimer declared the Resolution duly adopted.
RESOLUTION: Motion by Benson, seconded by Boggs, to adopt
Resolution #2020-01-468 entitled
“A Resolution Adopting the Amended Electric Heat Incentive Program
for the City of Anthon, Iowa”.
On roll call the vote was: ayes – Boggs, Benson, Hamman and Petersen; nays – none.
UNITED BANK SIGNATURES: Motion by Petersen, seconded by Boggs, to add Mayor Tammy Reimer, Mayor Pro-tem Jerry Boggs, City Clerk Jenifer Umbach and Deputy City Clerk Amy Buck to the checking account at United Bank of Iowa and remove Allan Pithan and Ruth Groth. Carried 4-0. Motion by Benson, seconded by Petersen, to add City Clerk Jenifer Umbach and Deputy City Clerk Amy Buck to the bank safety box and certificates of deposit at United Bank of Iowa and remove Ruth Groth. Carried 4-0.
APPOINTMENTS: Motion by Petersen, seconded by Hamman, to appoint Allyson Dirksen of Heidman Law Firm, P.L.L.C., Sioux City, Iowa as City Attorney. Carried 4-0. Motion by Petersen, seconded by Boggs, to appoint Ruth Groth as City Clerk until January 31, 2020 and Jenifer Umbach as City Clerk starting February 1, 2020. Carried 4-0. Motion by Petersen, seconded by Benson, to appoint Craig Handke as the WIMECA Representative. Carried 4-0.
COUNCIL COMMITTEES FY 2020: Mayor Reimer appointed Jerry Boggs Mayor Pro-tem, Allison Umbach head of Finance, Jerry Boggs head of Water, Lisa Petersen head of Electric, Corey Hamman head of Streets, Barb Benson head of Sanitation, Amy Buck the Housing Authority representative, Lisa Petersen the Landfill & E911 representative, Barb Benson & Jerry Boggs the Nuisance Committee and Allison Umbach & Tammy Reimer the Economic Development Committee.
2020/2021 BUDGET WORKSHOP: The budget workshop was set for January 27, 2020 at 5:30 pm. Motion by Petersen, seconded by Boggs to hold a public hearing on February 10, 2020 at 5:30 pm on the proposed property tax levy. Carried 4-0.
REPORTS/COMMUNICATIONS: Handke reported the power outages on December 26 and 30, 2019 were caused by the malfunction of two transformers. Ruth Groth, City Clerk, administered the “Oath of Office” to Tammy Reimer Dec 11, Corey Hamman on Dec 27 & Jerry Boggs on Dec 30, 2019 & Allison Umbach on Jan 14, 2020.
