Moville Legal Notice (Sale of Frontage Road Property)

LEGAL NOTICE

The City of Moville shall hold a public hearing concerning the sale of the following described property located at 631 Frontage Road, Moville, Iowa:

All of Lot Thirty-nine (39) and all that part of Lot Thirty-eight (38), described as follows:  Beginning at the Southeast Corner of Lot Thirty-eight (38), thence West along the South line of said Lot Thirty-eight (38), fifty-two and Two-tenths (52.2) feet to a point which is Fifty (50) feet West at right angles from the East line of said lot one hundred sixty-four and eight-tenths (164.8) feet to the North line thereof, thence East along said North line Fifty-two (52) feet to the Northeast Corner of said lot, thence South along the East line of said Lot Thirty-eight (38), one hundred sixty-six and three-tenths (166.3) feet to the place of beginning, together with the right of ingress and egress over the present paved portion of the remainder of said Lot  Thirty-eight (38), of Hebeler Sub-Division of the Town of Moville, in the County of Woodbury and State of Iowa.

The Hearing will be held November 18, 2020 at the City Hall, City of Moville at 6:00 P.M.  Seller will be accepting sealed bids on the above-described property until November 18, 2020, before 4:30 P.M.  The minimum bid must not be any lower than $1.00.  Any person interested in purchasing the property should submit a bid in writing in total dollars accurately describing the real estate to Jodi Peterson, City Clerk, at 21 West Main Street, Moville, Iowa 51039 on or before 4:30 P. M., November 18, 2020.  The bids on the property will be opened and an auction for the final sale of the property will occur on November 18, 2020, at 6:00 P.M at City Hall, City of Moville. The highest bidder on the day of sale will be expected to pay ten percent (10%) of the purchase price on that day and sign a contract for the balance of the purchase price.  A condition of the contract will be that Buyer must build a medical clinic/wellness center on the property by December 31, 2022.  The sale will be on contract and warranty deed delivered to the buyer upon fulfillment of the contract.  Closing shall be within 45 days from the date the contract is fulfilled and that is when the unpaid balance shall be paid in full.  Seller shall pay all the real estate taxes that become delinquent as of October 1, 2020.  Buyer shall pay all real estate taxes thereafter.

Possession shall be given on the date the contract is executed.

Any announcements day of sale shall supersede any statements made herein.

Seller reserves the right to reject any and all bids.

Any citizen may file oral or written comments for or against the sale of said property.
