CALL TO ORDER & ROLL CALL: Mayor Reimer called the regular meeting of the Anthon City Council to order on August 9, 2021 at 5:30 p.m. Council members present were Barbara Benson, Jonathan Kuhlmann, Lisa Petersen and Alan Pithan. Also present: Amy Buck, Tony Umbach, Craig Handke, Polly Pithan, Karen Newman, Allyson Dirksen, Mona Kirchgatter, Katie Cloud Paulsen, Mark Cloud and Kurt Paulsen.

AGENDA: Motion by Petersen, seconded by Pithan, to approve the meeting agenda. Carried 4-0.

POLICE REPORT: Mayor Reimer presented the monthly Police report that showed the Deputies patrolled 40 hours and 9 minutes and responded to 1 call for service.

CONSENT AGENDA: Motion by Benson, seconded by Petersen, to approve the consent agenda, which includes minutes from July 12, 2021 meeting and financial reports as filed, LIHEAP contract and Fireside Steakhouse LLC temporary liquor location. Passed with a record vote as follows: ayes – Benson, Kuhlman, Petersen and Pithan; nays – none.

PAYMENT OF CLAIMS: Motion by Petersen, seconded by Kuhlmann, to approve the list of bills as presented. Carried 4-0.

LEGAL: Allyson Dirksen, attorney, informed Council of the sheriff sale of property at 315 E. Main St. was cancelled and all citations and fees to the City were paid. Dirksen also reported the property at 207 S. Cauley Ave was recently sold on a tax sale and there are opportunities if the City were interested in pursuing the purchase of said property. The development agreement between the City and the Anthon Community Development Corporation (ACDC) was tabled until September meeting.

COUNCIL VACANCY: Notice of intent to fill a vacancy by appointment was published July 22, 2021. Motion by Benson, seconded by Pithan, to appoint Mona Kirchgatter to fill the remaining term of office vacated by Jerry Boggs. Carried 4-0. Oath of Office given at 5:51pm.

CONTRACT: No bids were received for the snow removal contract for 2021/2022 season. Clerk instructed to publish snow removal bid letting for the September 13, 2021 meeting.

ALAN PETERSEN: Alan Petersen submitted a variance request for the main water supply line at 102 Westgate Rd. Motion by Pithan, seconded by Petersen, to approve the variance request. Carried 5-0.

RESOLUTIONS: Motion by Petersen, seconded by Kuhlmann, to adopt
Resolution #2021-07-511
entitled “A Resolution Authorizing Use of Alternative Energy Interconnection Agreements and Setting the Fees Associated with the Same”.
On roll call the vote was: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none.

AMERICAN LEGION: No member of the Legion was present to discuss the O’Neill Park donation.

KURT & KATIE PAULSEN – COMMUNITY CATALYST BUILDING REMEDIATION PROGRAM FOR 101 N. 3RD AVE.: Motion by Petersen, seconded by Pithan to approve funding assistance of combined “in kind” and cash up to $10,000 by the city, should grant be received. Carried 5-0. Motion by Petersen, seconded by Kuhlmann, to adopt Resolution #2021-08-512 entitled “A Resolution Authorizing Mayor and City Clerk to Execute Documents on Behalf of the City of Anthon, Iowa”. On roll call the vote was: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none.

FARM LEASE: Motion by Pithan, seconded by Petersen to terminate the farm tenancy. Carried 5-0.

ORDINANCE 218: Pithan introduced
Ordinance #218 entitled,
“AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ANTHON, IOWA, BY AMENDING PROVISIONS PERTAINING TO INTERFERENCE WITH OFFICIAL ACTS”.
Pithan moved that the rule requiring that an ordinance be considered and voted on for passage at two council meetings prior to this meeting be suspended with respect to Ordinance #218. Motion was seconded by Petersen and passed with a roll call vote as follows: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none. Motion by Petersen, seconded by Kuhlmann, to pass and adopt Ordinance #218. On roll call the vote was: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none.

ORDINANCE 219: Benson introduced
Ordinance #219 entitled,
“AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ANTHON, IOWA, BY AMENDING PROVISIONS PERTAINING TO PUBLIC DISORDER”.
Pithan moved that the rule requiring that an ordinance be considered and voted on for passage at two council meetings prior to this meeting be suspended with respect to Ordinance #219. Motion was seconded by Petersen and passed with a roll call vote as follows: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none. Motion by Petersen, seconded by Pithan, to pass and adopt Ordinance #219. On roll call the vote was: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none.

ORDINANCE 220: Kirchgatter introduced
Ordinance #220 entitled,
“AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ANTHON, IOWA, BY AMENDING PROVISIONS PERTAINING TO ABANDONED VEHICLES”.
Pithan moved that the rule requiring that an ordinance be considered and voted on for passage at two council meetings prior to this meeting be suspended with respect to Ordinance #220. Motion was seconded by Petersen and passed with a roll call vote as follows: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none. Motion by Petersen, seconded by Kuhlmann, to pass and adopt Ordinance #220. On roll call the vote was: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none.

“AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ANTHON, IOWA, BY AMENDING PROVISIONS PERTAINING TO ALCOHOLIC BEVERAGE CONTROL”.
Pithan moved that the rule requiring that an ordinance be considered and voted on for passage at two council meetings prior to this meeting be suspended with respect to Ordinance #221. Motion was seconded by Petersen and passed with a roll call vote as follows: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none. Ordinance #222 entitled,
“AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ANTHON, IOWA, BY AMENDING PROVISIONS PERTAINING TO FAILURE TO ASSIST”.
Benson moved that the rule requiring that an ordinance be considered and voted on for passage at two council meetings prior to this meeting be suspended with respect to Ordinance #222. Motion was seconded by Petersen and passed with a roll call vote as follows: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none. Motion by Petersen, seconded by Kuhlmann, to pass and adopt Ordinance #222. On roll call the vote was: ayes – Benson, Kirchgatter, Kuhlmann, Petersen and Pithan; nays – none.

REPORTS/COMMUNICATIONS: Benson requested the City building at 200 W Main St be painted, in addition, Handke stated repairs are needed there and the building at 506 State St. Council agreed to look at locations before next meeting. Handke also reported the carps in the sewer lagoon are working well minimizing vegetation, a leak at the ballfield restrooms will be addressed this month, the house move from 502 E Bridge St will occur later this month, with a short scheduled power outage at that time. Handke also reported an electrical rate study has been scheduled. Clerk reported receiving State CARES Act money to purchase laptops for Council and Library.
